The Comprehensive Plan for the City of Shawnee was last updated in 2005. The Comprehensive Plan is used to direct the Planning Commission and city staff with making recommendations on zoning decisions. The Comprehensive Plan identifies growth areas and suggests ways to transition into desired zoning classifications.
The steps below outline the procedure for seeking a change in zoning classification. If both the Planning Commission and the City Commission agree to the use and find it compatible with the Comprehensive Plan, the change will become effective within 30 days unless approved by an Emergency Clause.
There are over 17 zoning districts allowed through the Zoning Ordinance. The more prominently used districts are identified below:
"R-1" Single Family
"R-2" Two Family
"C-1" Neighborhood Commercial
"C-2" Suburban Office
"C-3" Automotive & Commercial Recreation
"C-4" Central Business District
"C-5" General Commercial
"I-1" Restricted Light Industrial
"I-2" Light Industrial
"I-2" Heavy Industrial
"PUD" Planned Unit Development
The first step in seeking to have property rezoned is to complete the "Application for Change of Zoning Classification". This may be obtained at the City Planning Office at 222 N Broadway or by downloading the application form from the Forms Library. The applicant is advised to refer to the Comprehensive Plan to determine if the request is compatible.
The following information is needed to complete the application process:
Address of property
Legal description for property
Proposed use of property, and
Certified list of surrounding property owners within a 300-foot radius. List must be obtained from a bonded abstract company.
The filing fee for a rezoning request is $280, which is non-refundable once notices have been sent or published. The fee pays for staff review, the public notice mailings and postings in the paper.
The Planning Commission meets on the first and third Wednesday of each month at 1:30 PM in the City Commission Chambers. The application must be filed thirty (30) days prior to a regularly scheduled meeting. This allows staff to review the request, prepare notifications to the surrounding property owners and prepare the legal notification for the paper. The City Commission will hear the request at the first meeting date following the Planning Commission. The City Commission meets every first and third Monday of the month at 7:30 PM in the City Commission Chambers.
Once the application is compete, fees paid and the surrounding property owner listing presented to the Planning Department, the application will be scheduled for a Planning Commission meeting.
An applicant may represent himself or be represented by an attorney, engineer or realtor. Any supporting information may be submitted at the meeting. The chairman of the Planning Commission and Mayor will allow applicants and others to speak. The Planning Commission will make a recommendation to the City Commission. After all information is presented, the City Commission will either approve or deny the request. The decision of the City Commission is final with the only appeal being to district court.
If an application is denied, the applicant may re-file after six (6) months.
